This document is published in accordance with applicable provisions governing online platforms and constitutes the Terms of Use for access to and use of www.zefender.com ("Website"), including any related mobile website, digital platform, or online services (collectively referred to as the "Platform").

The Platform is owned and operated by Zefender Innovations Private Limited, a company incorporated under the Companies Act, with its registered office in Bengaluru, Karnataka (hereinafter referred to as "Zefender", "Company", "we", "our", or "us").

By accessing, browsing, purchasing from, or otherwise using the Platform or any of our products or services, you acknowledge that you have read, understood, and agree to be legally bound by these Terms and all policies incorporated herein by reference.

1. Acceptance of Terms

Your use of the Platform, purchase of products, request for quotations, installations, servicing, leasing arrangements, or any other interaction with Zefender constitutes a legally binding agreement between you and the Company.

Any additional or conflicting terms proposed by the user shall not apply unless expressly accepted by the Company in writing.

The Company reserves the right to modify these Terms at any time without prior notice. Continued use of the Platform after such modifications constitutes acceptance of the revised Terms.

2. User Information

You agree to provide true, accurate, complete, and current information whenever requested.

You are solely responsible for maintaining the confidentiality of your account information and for all activities carried out through your account.

3. Products and Services

Zefender manufactures and supplies custom-built industrial vending machines, helmet cleansing systems, automated kiosks, smart dispensing solutions, and related hardware and software products.

All products displayed on the Platform are intended for informational purposes. Product specifications, dimensions, colors, software features, and components may be modified, upgraded, or substituted without prior notice where such changes do not materially affect intended functionality.

Images displayed on the Platform are illustrative and may differ slightly from the delivered product.

4. Quotations, Orders and Payments

Quotations issued by Zefender remain valid only for the period specified therein.

Production shall commence only after receipt of the agreed advance payment.

Ownership of any product shall remain with Zefender until full payment has been received.

Failure to make timely payments may result in suspension of production, dispatch, installation, warranty services, or other obligations.

5. Installation Responsibilities

Where installation assistance is provided, the customer shall ensure:

• Proper electrical supply.

• Adequate grounding and earthing.

• Suitable installation location.

• Structural support where required.

• Safe operating conditions.

• Compliance with applicable local regulations.

The Company shall not be responsible for failures arising from improper site conditions or customer-side infrastructure.

6. Warranty

Warranty shall apply only as expressly stated in the written quotation, invoice, warranty certificate, or service agreement.

Warranty does not cover:

• Water damage

• Rust or corrosion

• Improper storage

• Electrical fluctuations

• Physical damage

• Vandalism

• Unauthorized modifications

• Third-party repairs

• Misuse

• Negligence

• Environmental damage

Any unauthorized repair, modification, or tampering may immediately void applicable warranty coverage.

7. Customer Responsibilities

The customer agrees to:

• Operate the equipment according to provided instructions.

• Perform recommended maintenance.

• Protect equipment from moisture and environmental damage.

• Avoid unauthorized repairs or modifications.

• Report defects promptly.

Failure to comply may affect warranty eligibility.

8. Website Content

The contents of the Platform, including designs, layouts, software, firmware, graphics, logos, documents, manuals, and product information, are the exclusive intellectual property of Zefender Innovations Private Limited.

Users shall not reproduce, copy, distribute, modify, reverse engineer, or commercially exploit any content without prior written permission.

9. Accuracy of Information

While reasonable efforts are made to keep information accurate and updated, neither Zefender nor any third party provides any warranty regarding:

• Accuracy

• Completeness

• Timeliness

• Suitability

• Availability

Users acknowledge that information may contain errors or omissions, and the Company excludes liability for such inaccuracies to the fullest extent permitted by law.

10. Prohibited Use

You agree not to use the Platform for any purpose that:

• Violates applicable laws.

• Infringes intellectual property rights.

• Interferes with Platform operations.

• Attempts unauthorized access.

• Introduces malicious software.

• Misrepresents association with Zefender.

11. Third-Party Services

The Platform may contain links to third-party websites or services.

Such links are provided solely for convenience.

Zefender shall not be responsible for the content, policies, products, or practices of third-party websites.

12. Limitation of Liability

To the maximum extent permitted by applicable law:

Zefender shall not be liable for:

• Loss of profits.

• Business interruption.

• Revenue loss.

• Goodwill loss.

• Indirect damages.

• Consequential damages.

• Incidental damages.

• Third-party claims.

• Loss arising from temporary downtime.

• Installation delays beyond reasonable control.

• Customer misuse.

• Environmental damage after delivery.

The Company's total liability, if any, shall not exceed the amount actually paid by the customer for the specific product giving rise to the claim.

13. Returned Equipment

Acceptance of any returned machine shall not constitute:

• Admission of fault.

• Acceptance of liability.

• Automatic refund obligation.

• Guaranteed buyback.

• Guaranteed compensation.

Returned machines shall be inspected for:

• Rust

• Water exposure

• Wiring alterations

• Missing components

• Electronic condition

• Display functionality

• Operational status

Any goodwill compensation or second-hand resale arrangement shall remain entirely at the Company's discretion.

14. Indemnification

You agree to indemnify, defend, and hold harmless Zefender Innovations Private Limited, its directors, employees, officers, agents, affiliates, and representatives against any claims, liabilities, damages, costs, penalties, or legal expenses arising from:

• Breach of these Terms.

• Violation of applicable law.

• Misuse of products.

• Unauthorized modifications.

• Third-party claims resulting from your actions.

15. Force Majeure

The Company shall not be liable for delays or failure to perform obligations due to events beyond reasonable control, including but not limited to:

• Natural disasters

• Floods

• Fire

• Pandemic

• Government restrictions

• Transportation disruptions

• Supplier shortages

• Electrical outages

• Labor disputes

• War or civil unrest

16. Governing Law

These Terms shall be governed by the laws of India.

All disputes arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the competent courts in Bengaluru, Karnataka.
